Estate Planning
Winston & Cashatt, Lawyers engage in all forms of estate planning, domestically and internationally. We represent individuals, businesses, fiduciaries, tax-exempt organizations and estates in matters ranging from estate plan preparation to the resolution of disputes over the management and distribution of family wealth. Our wide-ranging expertise spans the preparation of traditional wills and revocable trusts, family limited partnerships and limited liability companies, sales to internationally defective irrevocable trusts, and business succession planning. Other common planning matters include lifetime gift programs, charitable split interest trusts, asset protection trusts, private foundations, grantor retained annuity trusts, generation-skipping transfer tax planning and life insurance planning (including irrevocable life insurance trusts and split-dollar arrangements).
We also engage in all aspects of probate and trust administration, both domiciliary and ancillary. In addition to the administration process, tax-related activities for estates regularly include the preparation of estate tax and income tax returns, representation in estate tax controversies, and a full range of post-mortem planning (including qualified disclaimers and the use of the credit for tax on prior transfers).
The nature of the attorney-client relationship is crucial in legally complex, highly personal, and uniquely sensitive matters. Encouraging communication and interaction with our clients and their families better enables us to understand their unique objectives and offer practical guidance and legal counsel. Our client-centered approach helps us to anticipate legal pitfalls, design preventive strategies, and provide cost-effective solutions.
